1. Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts concluded by consumers or entrepreneurs (hereinafter “customers”) with LyDenti Elements, Michael Ochman sole proprietorship, via the online shop www.lydentielements.com.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor independent professional. An entrepreneur is any natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Conclusion of contract

2.1 The products presented in the online shop do not constitute a legally binding offer, but rather an invitation to the customer to place an order.

2.2 The customer can submit an offer using the order form integrated in the shop. After entering their personal data and clicking the "Place order with payment" button, the customer submits a binding offer.

2.3 The contract is concluded by acceptance of the offer by LyDenti Elements, either by express order confirmation by email or by dispatch of the goods within 5 working days.

2.4 If you select an immediate payment method (e.g. PayPal, Klarna), the contract is concluded upon completion of the payment process.

3. Prices and payment terms

3.1 The prices quoted are final prices including VAT plus shipping costs.

3.2 Payment methods: Prepayment (bank transfer), PayPal, Shopify Payments, Klarna (if available).

3.3 In case of advance payment, payment is due within 7 days.

4. Delivery and shipping conditions

4.1 Delivery will be made to the address provided by the customer via our shipping service provider (e.g. DHL).

4.2 If delivery is not possible and the goods are returned to us, the customer shall bear the costs if he is at fault.

5. Right of withdrawal

The statutory right of withdrawal for consumers applies. Details can be found in our cancellation policy.

6. Retention of title

The goods remain the property of LyDenti Elements until full payment has been made.

7. Warranty and Liability

7.1 The statutory liability for defects applies.

7.2 For businesses, the warranty period is one year from delivery.

8. Applicable law and place of jurisdiction

8.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

8.2 If the customer is a merchant, the exclusive place of jurisdiction is Berlin.

9. Contract language and storage of the contract text

9.1 The contract language is German.

9.2 The contract text will be saved by the seller and sent to the customer by email after the contract has been concluded.
